PAYMENT TERMS AND CONDITIONS

Contract to Purchase

The products and services on this website (Product) are offered for sale by Shug. By entering your details to make a purchase, you enter into a contract to purchase the Product on the terms and conditions set out below, the Privacy Policy and the relevant Product Terms and Conditions. This contract is deemed to be made at our registered premises.

Price
The price payable for the Product is set out in our website. Prices are in $AUD and are subject to GST. All payments made are non-refundable.  Any quotes you receive either from this website or from us in any other manner are only valid for fourteen (14) days from the date that the quote is generated. We are under no obligation whatsoever to honour quotes which are older than 14 days from the date on the quote itself.

Returns, Refunds and Exchanges Policy
How To Return An Item
Your item must be in its original unused condition to be returned, unless there is a manufacturer defect. Your must return the item within 14 days of your purchase.

2. Mail your returned item to:

3. Include in your package a signed letter stating the reason for your return and the original invoice.

Ordering Online

To place a order online please contact Shug Bollards on 1300 786 652 or email info@shug.com.au. I will provide you with a quote over the phone or via email. If you accept the quote I will issue you an invoice with the payment options.

Shipping

All orders are shipped within 72 hours Monday – Friday 9am – 5pm.

Shipping Rates

The rate charged for the shipping of your order is based on the weight/size of your products, and your location. I will contact you with a price for shipping and the shipping rate will appear on your invoice.

Back Orders

If an item goes on back order we will ship you the part of your order that is in stock. When the item becomes available we will ship you the rest of your order. You will not be charged any additional shipping and handling for the second shipment.

Payment Terms
Payment in full is expected before we release the order for shipping or installation. We accept EFT, cash and credit cards (No Cheques), a 2% processing fee will be charged with all credit card payments.(Strictly No 30 Day Terms)

The 50% deposit will be kept if the quoted client decides to pull out of the project for any reason other than unsatisfactory work. Unsatisfactory work is described as work delivered at a sub-standard quality and not according to the outline defined and agreed upon by Shug Bollards and the quoted client.

Installation
Installation costs are non-refundable

By contracting SHUG Bollards to supply and install bollards at your premises, you agree to the following:

It is your responsibility to ensure that no underground services, such as electrical cables, gas and water pipes, fibre optics, etc, will be affected by the installation work. You agree to arrange for the detection of such services before installation (please contact Damien at Utility Locating Victoria for assistance: 0417327570), and to make the detection report available to us if requested. SHUG Bollards is not responsible for disturbance or damage to any underground services.

Some surfaces, including concrete and asphalt, are prone to cracking or chipping during and after the drilling/cutting required for installation. SHUG Bollards is not responsible for repairs to these or any surfaces.

Core plugs, soil, and other associated rubble resulting from the installation will not be removed from site by SHUG Bollards unless by separate prior agreement. There may be an additional charge for this service.

Our quotations are based on the use of a standard drill and equipment. Damage to equipment caused by underground rubbish, such as steel, metal parts, rubble, or any other foreign bodies will be subject to additional charges.

On the day of installation, you or your representative must be available at the installation site at the agreed time, unless alternative arrangements have been made in advance. Our engineers are happy to wait up to 15 minutes from the agreed time, after which they will leave site and additional charges will apply.

Payment is required IN FULL before we can release your order for shipment and installation. We accept EFT, Cash, and Credit Cards only. Credit Card payments are subject to a 2% processing fee. For EFT payments, please email your remittance confirmation to shug@shug.com.au.

Credit Card and EFT
Payment must be affected by credit card using the ordering facility on the invoice. We only accept Visa & MasterCard. Orders that exceed your credit limit will not be processed.  A credit card processing fee of 2% of the total order price (including shipping) will apply.
Persons who pay for their bollard by electronic funds transfer must bring a copy of the EFT transaction record. Persons who pay by EFT should allow two business days for the payment to be received by us and reconciled to your order before coming to pick up the bollard. No bollard purchases will be able to be picked up or shipped unless they have been paid for in full.

Release and Events beyond our control
By taking delivery of a bollard or any other product from us you release us from, and agree that the we are not liable for any claim of any sort arising from:

1. damage, loss, injury or death from the use of the bollard;

2. any fault in the construction of the bollard;

You acknowledge that the purchase and use of the bollard is at your sole risk.
We shall have no liability to you for any failure to provide the Product or any delay in doing so which is caused by any event or circumstance beyond our reasonable control including, without limitation breakdown of systems or network access, flood, fire, explosion or accident or events deemed to be forces majeure.

Amendments
We may vary prices and also these terms and conditions at any time at our discretion. Any variations become effective on posting on the website. By making a purchase through this website after the terms and conditions have been varied you agree to be bound by that variation.
Security
Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us, including your credit card details, is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.

Entire Agreement
These terms and conditions together with the charges as listed on our website, contact details, Privacy Policy and relevant Product Terms and Conditions, set out the whole of our agreement relating to the provision of Products to you. Nothing said by any sales person or authorised representative about the nature and/or quality of any of the Products offered for sale by us is a variation of these terms and conditions. We shall have no responsibility for any such representation being untrue or misleading.

Governing law
Any right or obligation under these terms and conditions is governed by the laws in force in the state of Victoria, Australia and the parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in respect of any action that arises under these terms and conditions.
Waiver
The failure of Shug to exercise or enforce any right or provision of these terms and conditions does not constitute a waiver of such right or provision in that or in any instance.

Severability
If any provision of these terms and conditions are held to be invalid, unlawful void or otherwise unenforceable, then that provision will be deemed severed from these terms and conditions and will not effect the validity and enforceability of any remaining provisions.

Interpretation
In these terms and conditions, the singular includes the plural and vice versa, reference to a person includes any legal or business entity, the words “including” and “for example” have no limiting effect
